Free power of attorney and wills

Are you looking for a free power of attorney document or a free template for a last will and testament? If you are a resident of Michigan, there is a free resource for you to create these documents prior to taking them to a notary.

The Michigan State Bar Foundation created the Michigan Legal Help website to improve access to justice for all citizens of the state. They offer not only free power of attorney documents, but also free last wills and testaments and other legal documents to help you navigate the legal system.

While it’s very handy to have these free resources, they may not work for everyone. I always recommend that my clients consult with an attorney whenever possible, especially if they have a complex estate.

Also, keep in mind that Powers of Attorneys and Last Wills and Testaments must be notarized in front of witnesses. Your plan for completion of these documents should include finding witnesses or asking your notary to provide them.

While these documents are provided at no charge by the Michigan State Bar Foundation, notaries will still charge for their services. Notary fees are different across states, and notaries will usually charge extra for witnesses. Make sure you know what to expect. We post our fees online for full transparency and to help you plan for your signing.

Notaries in Michigan can only charge a maximum of $10 per stamp plus a travel fee. We cannot charge extra based on the type of document. Make sure you know what notaries in your state can legally charge by visiting the National Notary Association.
